Auto Form Filler – Terms of Use

Welcome to Auto Form Filler, a commercial auto form filling application available at https://autoformfiller.app (“App,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the App.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the App.  

1. Description of Services

Auto Form Filler is a software application that allows users to automatically fill multiple scanned commercial auto forms with pre-existing information. The App is designed to be easy to use, fast, and eliminate the need for manual data entry.

2. User Accounts

You may need to create an account (“Account”) to access certain features of the App. You are responsible for maintaining the confidentiality of your account information, including your login credentials, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach.  

3. Content

The App may contain content provided by us or by third parties (“Content”). We do not control the Content and make no guarantees about its accuracy, currency, completeness, reliability, or suitability. You use the Content at your own risk.

4. User Warranties

You represent and warrant that:

• You are of legal age to form a binding contract under applicable law.
• You will use the App in accordance with these Terms and all applicable laws and regulations.
• You will not use the App for any illegal or unauthorized purpose, including the introduction of viruses or malware.

5. Intellectual Property

The App and all content, features, and functionality on the App, including but not limited to text, graphics, logos, icons, and images, are protected by copyright, trademark, and other intellectual property laws. We own all right, title, and interest in and to the App and its Content.

6. Governing Law and Jurisdiction

These Terms and your use of the App will be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the exclusive personal jurisdiction and venue of such courts.  

7. No Return Policy

Due to the digital nature of the App, we have a strict no-return policy. Once you purchase a subscription or download the App, your purchase is final, and we will not provide refunds.

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We warrant that the App is free from viruses and malware.  

9. Limitation of Liability

IN NO EVENT SHALL WE, OUR AFFILIATES, OR OUR LICENSORS BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  

10. Termination

We may terminate your access to the App for any reason, at any time, without notice. We also reserve the right to modify or discontinue the App at any time, with or without notice.

11. Entire Agreement

These Terms constitute the entire agreement between you and us regarding your use of the App.

12. Changes to the Terms

We may revise these Terms at any time by updating this page. You are bound by any revisions and should therefore periodically visit this page to review the current Terms.

13. Privacy Policy

Our Privacy Policy outlines our practices regarding the collection, use, disclosure, and protection of your personal information. Please refer to our Privacy Policy for more details.  

14. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the App shall be resolved exclusively by binding arbitration in accordance with the rules of the American Arbitration Association (“AAA”). The arbitration shall be conducted in Miami-Dade County, Florida, and the award rendered in the arbitration shall be final and binding on both parties.  

15. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is caused by any event beyond our reasonable control, including but not limited to acts of God, acts of war, fire, flood, earthquake, labor disputes, or governmental actions.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and us regarding your use of the App and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
